DUECOURSE PRIVACY POLICY

Legal Learning Inc. (“DueCourse”, “We”, “Us”, “Our”) is sensitive to your concerns about how we use the personal information we collect from you through (a) our websites, including duecourse.coach (the “Site” and (b) our services, including the DueCourse application (the “App”) and our API. (The Site, App, and API are sometimes collectively referred to as "Online Services" for simplicity.) 

DueCourse takes your privacy seriously, and has implemented this privacy policy (the "Privacy Policy") and internal policies and practices to keep your personal and financial information secure. The Privacy Policy covers DueCourse's treatment of the Personally Identifiable Information we collect when you use the Online Services, in email, text, and other electronic messages between you and DueCourse, through mobile and desktop resources you download from the Online Services, and when you interact with our advertising and Online Services on third-party applications and services, if those services or advertising include links to this policy. It also describes the choices available to you regarding our use of your personal information and how you can access and update this information. This Privacy Policy is incorporated into our Website Terms of Service, and Platform User Terms of Service, and therefore governs your use of the Online Services. 

This policy does not apply to information collected by Us offline or through any other means, including any other website operated by DueCourse or any third party or any third party including through any application or content (including advertising) that may link or be accessible from or on the Online Services.

By using DueCourse Online Services, you accept the terms of this Privacy Policy. If you have questions or concerns about the Privacy Policy, please contact us at hello@duecourse.coach. If you do not agree with our policies and practices, do not use the Online Services.

What Information Do We Collect About Our Users and How Do We Collect It?

Traffic Data. DueCourse may collect a variety of visitor data such as IP addresses, browser settings, internet service provider (ISP) information, referring/exit pages, operating systems, date/time stamps, and clickstream data (collectively "Visitor Data"). The DueCourse internal servers and software automatically recognize Visitor Data. No Personally Identifiable Information is collected in this process. The Site may use Visitor Data to compile traffic data about the types of visitors who use the Site at specific intervals (collectively "Traffic Data").

We may use Traffic Data to analyze Site traffic, but this information is not examined for Personally Identifiable Information. We may also use Traffic Data to diagnose problems with our server, administer our Site, or display content according to your preferences. Visitor Data and Traffic Data may also be shared with business partners, affiliates, or advertisers on an aggregated and anonymous basis.

Cookies. DueCourse may use the standard cookie feature of major browser applications and third-party providers, including Google Analytics features, or employ internally developed cookies and tracking codes, that allow DueCourse to store a small piece of data on a visitor's computer, or any other device a visitor uses to access Online Services, about his or her visit to the Site or use of Applications. DueCourse does not capture Personally Identifiable Information in cookies or use cookies to mine Personally Identifiable Information. You can remove persistent cookies by following directions provided in your Internet browser’s “help” directory. If you reject cookies, you may still use our site, but your ability to use some areas of our site, such as order forms, will be limited.

3rd Party Tracking. The use of tracking technologies by our service providers, technology partners or other 3rd party assets (such as social media links) on the site is not covered by our Privacy Policy. These 3rd parties may use cookies, clear gifs, images, and scripts to help them better manage their content on our site. We do not have access or control over these technologies. We do not tie the information gathered to our Customers’ or Users’ Personally Identifiable Information.

Personal Information. DueCourse requires each user to provide us with personal information (collectively "Personally Identifiable Information") to access and use DueCourse products and services. Personally Identifiable Information is captured only when a visitor accesses Online Services, or speaks on the phone with a DueCourse employee or representative, and willingly discloses that information. This disclosure may occur when a visitor registers with an Online Service, engages in transactions, contacts customer service, or participates in contests, promotions, surveys, forums, content submissions, requests for suggestions, or other aspects of services offered by DueCourse.

Personally Identifiable Information includes: (i) "Contact Data" (such as your name, address, city, state, zip code, phone number, email address, and employer); (ii) "Financial Data" (such as your credit card number, expiration date, and verification code or bank account information); and (iii) "Demographic Data" (such as your zip code and sex).

We may collect the information of 3rd party individuals as necessary, such as to register authorized contacts to access their DueCourse account. DueCourse uses this information for the sole purpose of administering its services for our customers, and does not use such information for any other reason.

Testimonials and Reviews. We may display personal testimonials of satisfied customers. We will ask for your specific consent as part of the survey. If you wish to update or delete your testimonial, you can contact us at hello@duecourse.coach. We may also display customer reviews. If you provide a review that we display and wish to update or delete it, you can also contact us at hello@duecourse.coach.

Calls/Electronic Communications. In the regular course of our business, DueCourse may monitor and record phone conversations or email communications between you and DueCourse employees or representatives for training and quality assurance purposes. We may receive a confirmation when you open or click on content in an email from us, which helps us make our communications to you more useful and interesting. If you do not wish to receive email from DueCourse, you may unsubscribe from our mailing list on any of the emails we send.

We collect this information: 

  • First, directly from you when you provide it to us, such as entering your information into a questionnaire provided to you on the Online Services or signing up for an account.

  • Second, we collect generic information about your usage and equipment automatically as you navigate through the Online Services, such as usage details, IP addresses, web browser preferences, and information collected through cookies and other tracking technologies. Although we do not correlate tracking information to individuals, some information collected, such as IP addresses, will be unique.

You also may provide information to be published or displayed (hereinafter, “posted”) on public areas of the Online Services, or transmitted to other users of the Online Services or third parties (collectively, “User Contributions”). 

If applicable, your User Contributions are posted on and transmitted to others at your own risk. Additionally, we cannot control the actions of other users of the Online Services with whom you may choose to share your User Contributions. Therefore, we cannot and do not guarantee that your User Contributions will not be viewed by unauthorized persons. 

We reserve the right, at DueCourse’s sole discretion, to remove, either temporarily or permanently, any User Contribution for any reason whatsoever.  DueCourse’s right to remove any User Contribution does not obligate DueCourse to police, review or verify User Contributions in any way.  DueCourse is not liable for any User Contributions. 

The information we collect is used by DueCourse to identify users and provide them with services, support, sales and marketing action, billing, and to meet contractual obligations.


In some countries, including countries in the European Economic Area (“EEA”), the information referenced above in this Privacy Policy may be considered personal information under applicable data protection laws. If you do not want us to collect this information, do not use the Online Services. 

How Do We Use the Information We Collect and Do We Share the Information We Receive?

We use information we collect from the Online Services to communicate with you, develop, provide, and improve the Online Services and its services to you,  process your orders (if applicable) or provide you with information, products, or services that you request from us, facilitate your transactions with our third-party marketing partners, to carry out our obligations and enforce our rights arising from any contracts entered into between you and us, and inform you of offers, discounts, or changes to the Online Services or any products or services we offer or provide through it. For example, you may receive a welcome email that confirms your username and password, and later receive communications responding to your inquiries, providing services you request, and managing your account. We occasionally send service-related announcements, for example, to alert you if we need to temporarily suspend the Site or the App for maintenance.

Opting Out. We send promotional emails and newsletters from time to time to users who have registered on the site and to those who have opted in to receive such emails. Generally, you may not opt-out of service-related or transactional communications, which are not promotional. If you do not wish to receive service-related communications, you may terminate your account by contacting hello@duecourse.coach. However, you can opt-out of promotional communications by following the unsubscribe instructions in any communication or by emailing us at hello@duecourse.coach.

You may choose not to provide DueCourse with Personally Identifiable Information or you may turn off cookies in your browser by changing its settings. If you make these decisions, you may continue to use the Online Services and browse its pages. However, DueCourse cannot process orders without Personally Identifiable Information.

Surveys, Sweepstakes, and Contests. We may provide you the opportunity to participate in surveys on our site, to measure customer satisfaction. If you participate, we may request certain personally identifiable information from you. Participation in these surveys, sweepstakes, or contests is completely voluntary and you therefore have a choice whether or not to disclose this information. The requested information typically includes name, email address, and mailing address.

We share customer information with third parties only as follows:

Order Processing. DueCourse, sometimes with the assistance of a third party or DueCourse subsidiary, may use your Personally Identifiable Information to process your payment through merchant account services, and to generate the products and services you order. Your Contact Data may be used to follow up with you on transactions you initiate through Online Services, respond to inquiries made through Online Services, inform you of changes to Online Services, and send you additional information about DueCourse and its products and services.

Third Party Marketing. Unless specifically authorized by you, we do not provide Personally Identifiable Information to third parties for marketing purposes. If you express interest in a third party offer or purchase a package that includes a third party offer, we may provide your Personally Identifiable Information to that third party solely in connection with the offer you have selected.

Required by Law. We may also disclose your personal information: as required by law, such as in response to a subpoena or similar legal process, and when we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a legal request.

Visitor Demographics. Contact Data and Traffic Data are used to gather general statistics about our customers and visitors. We may use Demographic Data to generate collective information about our users, but not in a way that identifies any user specifically. For example, we may inform third parties about the number of registered users and unique visitors, and the pages most frequently browsed.

Service Providers. We may share your Personally Identifiable Information with companies that provide support services to us (such as a printer or email service provider), or help us market our products and services. These companies may need information about you in order to perform their functions. These companies are not authorized to use the information we share with them for any other purpose.

Partner and Affiliate Tracking. Our partners and affiliates, including Google Analytics, may use cookies, web beacons, or other tracking technologies to collect non-personally identifiable information about your activities on this and other websites to provide you targeted advertising based upon your interests. This means that these partners and affiliates may show our ads on sites across the Internet based upon your previous visits to our site. Together with our partners and affiliates, we may use these cookies and web beacons to report how your ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to your visits to our site.

With respect to our affiliates or partners, we do not control these third parties’ tracking technologies or how they may be used, therefore, if you have any questions about an advertisement or other targeting content, you should contact the responsible provider directly. 

Blogs and Forums. The Site may include a publicly accessible blog and interactive forums. You should be aware that any information you provide in these areas may be read, collected, and used by others who access them. You should use caution when deciding whether to disclose your personal information in these areas of the site. To request removal of your personal information from our community forums, contact us at info@duecourseapp.com. In some cases, we may not be able to remove your personal information, in which case we will let you know if we are unable to do so and why.

Aggregated Personal Data. In an ongoing effort to better understand and serve the users of our Online Services, we sometimes conduct research on our customer demographics, interests and behavior based on the Personal Data and other information provided to us. This research may be compiled and analyzed on an aggregate basis, and we may share this aggregate data with our affiliates, agents and business partners. This aggregate information does not identify you personally. We may also disclose aggregated user statistics in order to describe our Online Services to current and prospective business partners, and to other third parties for other lawful purposes.

Other Transfers. We may share Personally Identifiable Information and other data with businesses controlling, controlled by, or under common control with DueCourse. If DueCourse is merged, acquired, or sold, or if some or all of our assets or equity are transferred, we may disclose or transfer Personally Identifiable Information and other data in connection with the associated transactions.

Bankruptcy. In the event of a DueCourse bankruptcy, insolvency, reorganization, receivership, or assignment for the benefit of creditors, or the application of laws or equitable principles affecting creditors' rights generally, we may not be able to control how your personal information is treated, transferred, or used. If such an event occurs, your Personally Identifiable Information may be treated like any other DueCourse asset and sold, transferred, or shared with third parties, or used in ways not contemplated or permitted under this Privacy Policy. In this case, you will be notified via email and/or a prominent notice on our site of any change in ownership or uses of your personal information, as well as any choices you may have regarding your personal information.

Links

Third-Party Websites. DueCourse may maintain links to other websites and other websites may maintain links to the Online Services. This Privacy Policy applies only to duecourse.coach and not to other websites accessible from DueCourse or that you use to access DueCourse, each of which may have privacy policies materially different from this Privacy Policy. If you visit other websites, DueCourse is not responsible for the privacy practices or content of those sites. It is your responsibility to review the privacy policies of non-DueCourse websites to confirm that you understand and agree with them.

Do Not Track Settings

DueCourse uses, among other technologies, cookies to track its customers over time and across third party websites to provide targeted advertising and/or accurate Site traffic data, however, if a user opts out through our Site and the cookie banner when this option is provided to you, DueCourse will no longer track your actions on the Site. DueCourse does respond to Do Not Track (DNT) signals. However, as referenced above, some third party websites track your browsing activities when you use their websites so that they can tailor their content to your preferences. If you are visiting such sites, your web browser may allow you to set the DNT signal on your browser so that third parties (particularly advertisers) know you do not want to be tracked.

Children Under the Age of 13

The Online Services are not designed for or intended for use by children and you are not allowed to use the Online Services or provide information on it if you are under the age of 13. DueCourse does not knowingly collect Personal Data from children under the age of 13, however, if we learn we have received personal information from or about a child under the age of 13 without verification of parental consent, we will delete that information immediately. If you are under the age of 13, please do not submit any Personal Data through our Online Services. If you have reason to believe that a child under the age of 13 has provided Personal Data to DueCourse through our Online Services, please contact us, and we will  delete that information from our databases.

If you are based in the EEA you may only use the Online Services if you are over the age at which you can provide consent to data processing under the laws of your country or if verifiable parental consent for your use of the Online Services has been provided to us. 

Accessing and Changing Your Account

User and Authorized Contact Access to Order Information. DueCourse will give you, or anyone listed as an authorized contact for your account (as applicable), information about your order. This may include information about the nature and status of your order, information you provided to process your order, payment information, and contact information. If you want someone to have access to your order, you must list them as an authorized contact or they may not obtain information.

If you no longer desire our services, or if you want to remove your Personally Identifiable Information from the Online Services, you may terminate your account by contacting hello@duecourse.coach.

User Access to Account Information. You can review and change your personal information by logging into the Online Services and visiting your account profile page. You may also send us an email at hello@duecourse.coach to request access to, correct, or delete any personal information that you have provided to us. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect. If you delete your User Contributions from the Online Services, copies of your User Contributions may remain viewable in cached and archived pages, or might have been copied or stored by other users. 

Data Retention. At minimum, we will retain your information for as long as we have an ongoing legitimate business need to do so (for example, as needed to provide you services, and as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements). DueCourse may maintain some or all of this data in its archives even after it has been removed from the Online Services. When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it or, if that is not possible (for example, because your personal information has been stored or maintained in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.

Your California Privacy Rights  

California Civil Code Section § 1798.83 permits users of the Online Services that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. Transferring your information

DueCourse is a worldwide service. By using the Online Services, you authorize us to transfer and store your information outside your home country, including in the United States, for the purposes described in this policy. The privacy protections and the rights of authorities to access your information in these countries may not be the same as in your home country. We take additional measures when information is transferred from the European Economic Area (EEA). This includes having standard clauses approved by the European Commission in our contracts with parties that receive information outside the EEA. We also rely on European Commission adequacy decisions about certain countries, as applicable, for data transfers to countries outside the EEA.

Legal Basis for Processing Personally Identifiable Information

Our legal basis for collecting and using the personal information described in this Privacy Policy will depend on the personal information concerned and the specific context in which we collect it. However, we will normally collect personal information from you only (i) where we need the personal information to perform a contract with you; (ii) where the processing is in our legitimate interests and not overridden by your rights; or (iii) where we have your consent to do so.  We have a legitimate interest in operating our Online Services and communicating with you as necessary to provide these Online Services, for example when responding to your queries, improving our Online Services, undertaking marketing, or for the purposes of detecting or preventing illegal activities.

In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person. If we ask you to provide personal information to comply with a legal requirement or to perform a contract with you, we will make this clear at the relevant time and advise you whether the provision of your personal information is mandatory or not (as well as of the possible consequences if you do not provide your personal information). 

How Secure Is the Personal Information We Collect?

Our Commitment to Data Security. We strive to make certain that our servers and connections incorporate the latest encryption and security devices. We have implemented physical, electronic, and managerial procedures to safeguard and secure the information we collect. Credit card and personal information are transmitted by secure socket layer technology servers (SSL). In addition, access by a user to their personal information is available through a password and unique username/ID selected by the user, which is also encrypted by SSL and encrypted when it is stored by us to prevent unauthorized parties from viewing such information. We perform regular malware scanning of the Online Services and all servers and computers used by us to support the Online Services. Unfortunately, no data transmission is guaranteed to be 100% secure and we therefore cannot guarantee the security of information you transmit to or from the Site, Applications, or through the use of our services, and you provide this information at your own risk. ACCORDINGLY, WE DISCLAIM LIABILITY FOR THE THEFT, LOSS, OR INTERCEPTION OF, OR UNAUTHORIZED ACCESS OR DAMAGE TO, YOUR DATA OR COMMUNICATIONS BY USING THE SITE, APP, AND OUR SERVICES. YOU ACKNOWLEDGE THAT YOU UNDERSTAND AND ASSUME THESE RISKS.

EEA Users

You have options in relation to the information and data that we have about you.  To exercise any of the options discussed below, please contact us at hello@duecourse.coach. If you’re an EEA user, you may:

  • Access the information we have about you. We will make an effort to share this information with you within a reasonable time.

  • Have your information corrected or deleted. 

  • Object to us processing your information. You can ask us to stop using your information, including when we use your information to send you marketing emails. If applicable, we will only send you marketing material if you've agreed to it, but if you'd rather we don't, you can easily unsubscribe at any time by clicking on the “unsubscribe” or “opt-out” link in the marketing emails we send you, or by emailing us at the email address above. 

  • Withdraw your consent for us to collect and process your personal information at any time.  Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect the processing of your personal information conducted in reliance on lawful processing grounds other than consent.

  • Have the information you provided to us sent to another organization, where we hold this information with your consent or for the performance of a contract with you, where it's technically feasible.

  • Complain to a regulator. If you're based in the EEA and think that we haven't complied with data protection laws, you have a right to lodge a complaint with the Data Protection Commission in Ireland or with your local supervisory authority.

We respond to all requests we receive from individuals wishing to exercise their data protection rights in accordance with applicable data protection laws. 

Enforcement. We periodically review this Privacy Policy and our compliance with it to verify that both are accurate. We encourage you to contact us with any concerns, and we will investigate and attempt to resolve any complaints and disputes about our privacy practices.

Changes to this Policy. We may update this Privacy Policy to reflect changes to our information and privacy practices. If we make any material changes a notice will be posted on this page. We encourage you to periodically review this page for the latest information on our privacy practices.
